1. Industrial Bank of Korea (IBK) Case Initial Assessment | ㅇ The Korean NCP deliberated and adopted the initial assessment of the complaint filed by the Industrial Bank of Korea (IBK) Branch of the Korean Financial Industry Union against IBK. ㅇ The KNCP determined that this case does not merit further examination. - Given that the purpose of the NCP system is to address issues such as human rights arising from disputes related to the international investment and trade activities of multinational enterprises, it was considered more appropriate to take a principles-based approach rather than being influenced by external factors such as public opinion, particularly in light of limited resources and capacity. - However, the KNCP recommends that the Respondent, as a public institution, not only comply fully with applicable laws and regulations but also strengthen its efforts to implement responsible business conduct and improve relevant systems to protect labor rights, including by continuing to engage in constructive dialogue and collective bargaining with workers as their employer, while reflecting future policy developments. |
2. Lotte Corporation, Lotte Shopping Case Initial Assessment | ㅇ The Korean NCP deliberated and adopted the initial assessment of the complaint filed by Hoang Gia Trading & Services against Lotte Corporation, Lotte Shopping. ㅇ The KNCP determined that this case does not merit further examination. - However, the KNCP recommends that the Respondent further enhance its implementation of responsible business conduct, including by promoting transparent communication with its business counterpart(s) and establishing responsible business practices. ㅇ Furthermore, some members pointed that if cases that are essentially simple contractual or commercial disputes, as in this case, continue to be framed and raised as responsible business conduct (RBC) issues, this could lead to the inefficient use of the NCP’s administrative and financial resources and hinder its core functions. Accordingly, there was a view that revisions to the operational rules may be necessary to help prevent such situations in the future. |

Current Status and Plan of Nitto Denko Case (Reporting) | ㅇ The KNCP shared updates on the status and future plans of a specific instance submitted by the Korean Metal Workers’ Union (KMWU) and the Korean Confederation of Trade Unions (KCTU) against Nitto Denko, a company headquartered in Japan. |
